Terms of Service

1. Acceptance of Terms

By accessing or using oomfcheck ("the Service", "we", "us", "our") you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service. These terms apply to all users including subscribers (registered account holders) and requesters (people sending messages).

2. Description of the Service

oomfcheck is a notification and welfare check service. Subscribers register their Twitter/X account and a phone number. Twitter/X followers of a subscriber may pay a small fee to send the subscriber a message. If the subscriber does not respond within a configured time window, an emergency contact nominated by the subscriber is notified by SMS.

The Service also monitors subscriber Twitter/X account activity on a weekly basis and may trigger emergency contact alerts if a surge of reach-out requests is received within a short period.

3. Not an Emergency Service

oomfcheck is a supplementary notification tool only. It is not an emergency service, a crisis helpline, or a professional welfare check service. You expressly acknowledge and agree that:

• oomfcheck must not be used as your primary or sole means of seeking help in an emergency.
• Delivery of SMS notifications depends on third-party providers (see Section 8) and cannot be guaranteed to be instant or uninterrupted.
• The Service operates on a best-efforts basis. Cron jobs, SMS delivery, and Twitter API availability may be subject to delays, outages, or failures outside our control.
• We bear no responsibility for any harm arising from reliance on this Service in an emergency situation.

4. Eligibility

• You must be at least 18 years old to register as a subscriber or send a message.
• You must have a valid Twitter/X account to use the Service.
• By registering, you confirm that the emergency contact you nominate has consented to receive SMS notifications from oomfcheck on your behalf.

5. Subscriber Responsibilities

• You are responsible for keeping your registered phone number and emergency contact details accurate and up to date.
• You are responsible for ensuring your nominated emergency contact is aware of and consents to their role.
• You must not register a Twitter/X handle that you do not own or have authorisation to use.
• You are responsible for your account security. Treat your registered phone number as a credential — anyone with access to your phone can log in to oomfcheck.

6. Requester Responsibilities

• Messages sent via oomfcheck must be genuine welfare enquiries. You must not use the Service to send spam, harassment, threats, or any unlawful content.
• You confirm that you are a genuine Twitter/X follower of the subscriber at the time of sending.
• Payments are non-refundable once a message has been sent to the subscriber's phone number.

7. Payments

A fee of $1.00 USD (or equivalent) is charged per message sent. Payment is processed by PayPal. By making a payment you also agree to PayPal's User Agreement. We do not store your card or bank details.

Payments are non-refundable once the subscriber's SMS has been dispatched. If technical failure prevents delivery, please contact us to discuss a remedy.

8. Third-Party Service Providers

The Service relies on the following third-party providers. We are not responsible for the availability, performance, or conduct of these services, and we expressly exclude liability for any failure, delay, error, or loss caused by them:

Twitter / X

We use the Twitter/X API to look up account information, retrieve follower data, and verify user identity. Twitter/X may change, restrict, or discontinue API access at any time. We cannot guarantee continued compatibility with Twitter/X services. Your use of Twitter/X is governed by X's Terms of Service.

Twilio

SMS notifications are sent via Twilio. SMS delivery is not guaranteed and may be delayed or fail due to carrier restrictions, network issues, incorrect phone numbers, or Twilio service disruptions. We are not liable for SMS delivery failures or delays. Twilio's use of your phone number is governed by Twilio's Terms of Service.

PayPal

Payments are processed by PayPal. We do not control PayPal's payment processing, availability, or dispute resolution. Any payment disputes must be resolved with PayPal directly. PayPal's services are governed by PayPal's User Agreement.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free;
• Any notifications will be delivered within any particular time frame;
• The Service will meet your requirements or expectations.

10. Limitation of Liability

To the maximum extent permitted by applicable law, oomfcheck and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from:

• Your use of or inability to use the Service;
• Failure or delay of SMS delivery, Twitter/X API calls, or PayPal payment processing;
• Reliance on the Service in an emergency or welfare situation;
• Unauthorised access to your account;
• Any act or omission of a third-party provider.

In no event shall our total aggregate liability to you exceed the amount you paid to use the Service in the twelve months preceding the event giving rise to the claim.

11. Prohibited Use

You must not use the Service to:

• Send threatening, abusive, defamatory, or illegal content;
• Impersonate another person or falsely claim to be a follower of a subscriber;
• Attempt to circumvent rate limits, access controls, or any security measure;
• Scrape, reverse-engineer, or use the Service in a way that places unreasonable load on our infrastructure or Twitter/X's API.

We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.

12. Termination

You may delete your subscriber account at any time by contacting us. We reserve the right to suspend or delete accounts that violate these terms, are inactive for an extended period, or whose registration details become invalid.

13. Changes to These Terms

We may revise these terms at any time. The "last updated" date at the top reflects the most recent revision. Continued use of the Service after changes constitutes your acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the jurisdiction in which the operator of oomfcheck is based. Any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
